This Privacy Statement is effective as of July 15, 2015.

Introduction

Thank you for your interest in the BMWGroupDirect.com website (together with any successor or mirror website and any related mobile or tablet application, the “Site”), which is operated by RMS Automotive, LLC (“RMS Automotive”) for and on behalf of its customer, BMW Financial Services NA, LLC (“BMW FS”). All references in this Privacy Statement to “we” or “our” refer to RMS Automotive. We respect the privacy of our users when they use the Site. By using the Site, you consent to the use of your information and information about you in accordance with this Privacy Statement.

This Privacy Statement applies to information collected through the Site and does not describe the collection, use and disclosure practices of any of our corporate affiliates or third parties (including BMW FS). For information on the collection, use and disclosure practices of any other company with whom you are doing business, whether or not affiliated with RMS Automotive or BMW FS, please review their privacy policies.

Services offered by the Site are not directed to individuals under the age of eighteen (18). If you are under eighteen (18), you should not provide any personal information to us.

Information We Collect

Information is gathered from the Site by us, our service providers, advertisers, sponsors and partners.

Information You Provide. We may collect information that you choose to provide on the Site (which may include your name, address, telephone number, email address, dealer or company name, AuctionACCESS number(s), government ID and bank account, payment and other financial information) in a variety of ways, such as when you:

register your account;
purchase a vehicle or engage in any other transaction on or through the Site.
provide payment information or authorize electronic ACH transfers or other payments;
subscribe to newsletters or provide feedback; and
participate in surveys, sweepstakes or other promotions.

Automated Information. Information regarding your use of the Site may be collected and/or aggregated through the use of automated means. This automatically collected information may include information such as:

your IP address, the type of browser and operating system used;
date and time you access the Site and pages you visit, and if you linked from or to another website, the address of that website;
email you open and links you click on within those emails; and
your ISP or mobile carrier, and the type of handheld or mobile device that you used.

Data Technologies. Various technologies are used to automatically collect information, such as cookies, local shared objects, and web beacons (generally referred to as “Data Technologies.”) “Cookies” are small identifiers sent from a web server that are stored on your device for the purpose of identifying your browser or storing information or settings in your browser. “Local shared objects,” sometimes known as Flash cookies, may be used to store your preferences or display content based upon what you have viewed on various websites to personalize your visit. A “web beacon,” also known as an Internet tag, pixel tag or clear GIF, links web pages to web servers and their cookies. Anonymous advertising identifiers are increasingly being used on mobile devices and otherwise in a manner similar to cookies. When we refer to Data Technologies, we are including all current and similar future technologies. One or more Data Technologies may be used on the Site and other websites and mobile applications (that may not be the Site) by us, by another party on our behalf, or by third parties in accordance with their privacy policies. Data Technologies may be used by us and others, on our behalf and on their own behalf, to transmit information to you or about you and connect information about you from different sources, websites, devices, and mobile applications.

Location Information. We may collect physical location information that is sufficiently precise to allow us to locate a specific person or device (“Location Information”). We only collect Location Information with your permission (e.g., such as when you agree to provide it to us after initial access to or downloading of the Site). We may use Location Information and provide it to third parties to provide you with content and services that are relevant to a particular location, such as vehicle transport charges, available services in the area and directions.

Publicly Posted Information. Information that you make available to us and others via social media networks, forums, blogs, list serves, chat rooms or similar functionality is public information that we or others may share or use in accordance with the law.

Information from Other Sources and Combined Information. We may receive information about you from BMW FS or from other customers and third parties with which we have a commercial relationship. We may combine information that you provide to us with the information we receive from BMW FS and other sources, as well as with other information that is automatically collected. The combined information may include information about your use of the Site, your use of other websites, devices and mobile applications and your dealings with BMW FS and other third parties.

How We May Use the Information We Collect

We may use information we collect or receive for the following purposes:

for everyday business purposes, such as establishing and managing your user account, providing products and services you request, and providing customer support;
to offer our other products or services and/or the products or services of others to you;
to communicate about, and administer your participation in, special events, sales, programs, surveys, contests, sweepstakes and other offers or promotions;
to enable you to interact with the Site and other dealers and third parties (including BMW FS) through various means;
to evaluate and improve our business and the business of our affiliates, including developing new products and services and analyzing the effectiveness of products, services, applications and websites;
to diagnose and address technical and service problems;
to perform data analyses, including market and consumer research, trend analysis, demographic analysis and financial analysis;
to deliver content (including advertising) correlating to your interests and browsing and usage history, both within the Site and on other websites and applications;
to comply with applicable legal requirements and our policies and the policies of BMW FS;
to provide vehicle sale information, transaction data and other information and material to BMW FS; and
to contact you via telephone, text or chat (and by using the Site and agreeing to the Terms of Use, you agree to be contacted by RMS Automotive and BMW FS by telephone, text or chat at any number or other contact information that you may provide or make available on or through the Site).

Advertising Networks

Advertising that is customized based on predictions generated over time from your visits across different websites, devices and mobile applications is sometimes called “online behavioral” or “interest-based” advertising. We may partner with advertising networks, which are companies that deliver targeted advertisements to consumers and generate statistics and metrics related to the delivery of interest-based advertisements. We or these advertising networks may utilize information collected through a variety of Data Technologies to provide customization, auditing, research and reporting for us, our affiliates and other advertisers. This data collection takes place both on the Site and on third party websites and mobile applications. This process allows the Site and third parties to deliver targeted advertising on the Site or on third party sites, enhance marketing programs and help track the effectiveness of such efforts.

Our advertising networks also may use this information for determining or predicting the characteristics and preferences of their respective advertising audiences and measuring the effectiveness of their advertising in accordance with their privacy policies.

We do not provide information that is directly associated with a specific person (such as name and address) to an advertising network when you interact with or view a customized advertisement. However, when you view or interact with an advertisement, the advertiser may make an assumption that you are interested in the subject matter of the advertisement.

Some companies disclose when they are using interest-based advertising programs on the Site to deliver third party ads or collecting information about your visit for these purposes and give you the ability to opt-out of this use of your information. You may see an icon in or around third party advertisements on a website that uses interest-based advertising programs and on pages where data is collected and used for online interest-based advertising. Clicking on this icon will provide additional information about the companies and data practices that were used to deliver the ad. Information We Share

We do not sell or otherwise share information about you that we collect or receive, except as described below:

Affiliates. Information collected, including personal information and Data Technologies, may be shared with our affiliates, and their agents and third party service providers, who will use that information in accordance with their own privacy policies. Customers. We may share information about you, including personal information, vehicle sale and other transaction data and Data Technologies, with BMW FS and our other customers and commercial partners who will use that information in accordance with their own privacy policies.
Our Service Providers. We may engage third parties to provide the services offered through or in connection with the Site on our behalf. We require such providers to maintain information about you as confidential and to use the information only to perform the services specified by us in a manner consistent with this Privacy Statement.
Corporate and Asset Transactions. If we sell all or substantially all of our business or sell or transfer all or a material part of our assets, or are otherwise involved in a merger or transfer of all or a substantial part of our business (including any sale or transfer that may take place as part of or in connection with any bankruptcy or insolvency proceeding), we may transfer some or all of the information we have collected or received, including personal information, to the party or parties involved in the transaction as part of that transaction.
Other. We may access or disclose information, including personal information, to:
(a) protect or defend our interests and the legal rights or property of RMS Automotive and our affiliates;

(b) protect the rights, interests, safety and security of users of the Site or members of the public;

(c) protect against fraud or for risk management purposes; or

(d) comply with prudent legal practice as we may determine, and applicable law or legal process.

Your Choices

You are entitled to make certain choices about how we communicate with you.

You may choose not to provide personal information, even though that might impact your ability to register or open an account on the Site or receive a particular product or service.
If you do not want to receive marketing email from the Site, you can follow the unsubscribe link provided in those emails.
If you do not want to receive interest-based advertisements, you can opt out as discussed in the “Advertising Networks” section above.
You have a number of choices regarding certain Data Technologies. Most web browsers automatically accept cookies, but you can usually modify your browser’s setting to decline cookies if you prefer. You may also render some web beacons unusable by rejecting their associated cookies and disable or delete similar data used by browser add-ons, such as Flash cookies, by changing the add-on’s settings or opting out at Ghosteryenterprise.com or the website of the technology provider. If you choose to decline cookies or similar technologies, however, please note that certain features on the Site may not function properly or at all as a result. You may be able to adjust the use of advertising identifiers on mobile devices through the settings on your device. Finally, if you do not want to use a uniquely generated telephone number, you may choose to not call us.
If you do not want us to use Location Information, you can decline our initial invitation to provide that information, or opt out by changing the location services settings on your mobile device. However, please note that certain features on the Site may not function properly or at all as a result if you opt out.

Your California Privacy Rights

California Civil Code Section 1798.83 entitles California users to request information concerning whether a business has disclosed certain information about you to any third parties for the third parties’ direct marketing purposes. California users who wish to request further information in compliance with this law or have questions or concerns about our privacy practices and policies may contact us as specified in the “How to Contact Us” section below.

Online Tracking Policy for California Residents. As of the effective date of this Privacy Statement, there is no commonly accepted response for Do Not Track signals initiated by browsers, therefore we do not respond to them.

Access and Correction

Access to information that we collect and maintain about you may be available to you. For example, if you created a password-protected account within the Site, you can access that account to update the information you previously provided. Additionally, if you believe that information we maintain about you is inaccurate, subject to applicable law, you may request that we correct or amend the information by contacting us as indicated in the “How to Contact Us” section below.

Links

The Site may contain links to websites not operated by us, as well as third party widgets and applications discussed above. Once you leave the Site, we suggest that you review the applicable privacy policy of the third party website or application. We are not responsible for the content or use of any websites or applications other than on the Site or the privacy practices of those websites or applications.

Data Security

We use commercially reasonable administrative, technical, personnel, and physical security measures designed to safeguard information about you in our possession against loss, theft and unauthorized use, disclosure or modification. Of course, despite these measures, we cannot guarantee perfect security of networks, servers and databases we operate or that are operated on our behalf.

Disputes

If you choose to visit the Site, your visit and any dispute regarding privacy is subject to this Privacy Statement and any applicable Terms of Use, including any limitations of liability, arbitration and dispute resolution provisions and provisions relating to governing law or jurisdiction or venue that may be included in any of the foregoing.

Updates to this Privacy Statement

We may update this Privacy Statement to provide clarification or notice of changes to our practices. If we make changes, we will revise the date at the top of this Privacy Statement. We will provide you with notice of material changes by posting notice of the changes on the Site, or by providing you with notice by email or when you log into your account on the Site.

The BMWGroupDirect.com website (the "Site") is provided by BMW Financial Services NA, LLC ("BMW FS") through its third-party service provider, Manheim Remarketing, Inc. (“Manheim”) f/k/a/ RMS Automotive, LLC. These Terms of Use will govern your use of the Site and any Vehicle purchase or other transaction that may take place on or through the Site. AS used in these Terms of Use, you" or "your” refers to you as a user of the Site and your Dealership (as defined below), and "buyer "refers to you and any other purchaser of a vehicle listed on the Site (each, a "Vehicle").

By clicking your acceptance of these Terms of Use when registering or logging into your account on the Site, or by otherwise using or accessing the Site, you are (i) certifying to BMW Financial Services NA, LLC and Manheim that you are an authorized representative of your dealership("Dealership"), and that the authorizations and agreements below are being made in your representative capacity for and on behalf of your Dealership; (ii) agreeing that you and your Dealership will be bound by these Terms of Use, as updated from time to time; and (iii) agreeing that you have reviewed and understand the BMWGroupDirect.com Privacy Statement and the Manheim Privacy Policy located in the Manheim Marketplace Policies, as defined below. These Terms of Use are legally binding, with the same legal effect as a signed, written agreement entered into with BMW Financial Services NA, LLC and Manheim. In addition to these Terms of Use, and as manifested by clicking your acceptance when registering or by otherwise using or accessing the Site, you also acknowledge and agree to the Manheim Marketplace Policies, defined below, as amended from time to time, and that, in accessing and transacting on this Site, you are entering into a contractual relationship with Manheim as well as with BMW Financial Services NA, LLC. The Manheim Marketplace Policies can be found at https://publish.manheim.com/en/marketplace-policies/us-policies.html (the “Manheim Marketplace Policies”). Except as otherwise stated herein, the Manheim Marketplace Policies, including the Manheim Terms and Conditions, shall apply between you and Manheim, including but not limited to the arbitration, setoff, and limitation of liability terms therein.

1. Vehicle Purchases. Each Vehicle listed on the Site is owned and being offered for sale by BMW Financial Services NA, LLC (either for its own account, or as service to Financial Services Vehicle Trust, or for the account of a BMW Financial Services NA, LLC affiliate). Vehicles being sold in a "Buy it Now" format will be sold to the buyer at the price listed on the Site. Vehicles being sold in an auction (bidding environment) will be sold to the highest bidder, unless the Vehicle's designated reserve price has not been met, in which case BMW Financial Services NA, LLC reserves the right to end the auction and either relist the Vehicle or remove it from the Site entirely. By clicking on the "Buy" or "Bid "or any similar button in any Vehicle listing, you are committing to purchase the listed Vehicle at the designated price in accordance with these Terms of Use. All purchases are final and any issues or disputes involving a Vehicle purchased on the Site will be resolved exclusively through the BMW Financial Services NA, LLC arbitration process described below. BMW Financial Services NA, LLC and Manheim reserve the right to void or cancel any Vehicle purchase or other transaction that may take place on or through the Site.

2. Dealer Account. Once you have registered your account on the Site, you will be issued a unique username and password which you will use to access the Site. Manheim participates in the AuctionACCESS® registration system, and the AuctionACCESS number and other registration information assigned to your Dealership during the AuctionACCESS registration process will be linked to the Dealership's account and used for purchases made by the Dealership and its users on the Site. You are responsible for protecting your username and password and your Dealership is fully responsible for all purchases and other activities that are made or initiated using your account or your username and password (including, without limitation, any purchases or other activities made or initiated by any person that is designated as an "Authorized Representative" or "Authorized User of the Dealership in the AuctionACCESS system). The Dealership unconditionally guarantees all purchases and other transactions may or initiated using any Dealership account on the Site.

3. Accuracy of lnformation. You certify that all registration and representative inforn1ation you have provided to us, via AuctionACCESS and otherwise, is true, correct, and complete. You agree to promptly update your information via AuctionACCESS if there is any change to the information you have provided.

4. Proxy Bidding. The Site may allow you to place automatic proxy bids, which allows you to specify in advance your Max Bid for a particular Vehicle. If you place a proxy bid on the Site, the system will automatically bid on the applicable Vehicle for you in the bidding increments indicated on the listing, up to your specified "Max Bid". You may also have the ability to place a "Match Reserve” proxy bid for a particular Vehicle where the system will automatically increase your final bid to match the designated reserve price for the Vehicle if you are the highest bidder, the reserve price has not been met and your Max Bid is higher than the reserve price. Proxy bids are confidential and will not be known to other bidders or to BMW Financial Services NA, LLC. Sometimes there may be multiple bids for a Vehicle in the same amount. In these cases, priority is given to the highest bid that is placed first, either by regular bid or by proxy bid.

5. Vehicle Condition and History Reports. Vehicles listed on the Site may have been assigned an AutoGrade Condition Score based on the overall condition of the Vehicle and may also include an AutoCheck and/or Carfax vehicle history report ("VHR"). AutoGrade Condition Scores, and VHRs are issued and provided by third parties. BMW Financial Services NA, LLC and Manheim make no representation, warranty or guaranty of any kind or nature regarding the accuracy or completeness of any AutoGrade conditions core or VHR. Once you have purchased a vehicle, it is your responsibility to inspect the vehicle and ensure that any missing equipment, undisclosed damage or other issues are acknowledged in writing immediately, before you take possession of the vehicle. BMW Financial Services NA, LLC may not announce every vehicle as having been part of a National Highway Traffic and Safety Administration but makes every effort to repair such vehicles prior to listing them for sale on the Site. All buyers have a responsibility to confirm any DMV fees currently due prior to bidding as BMW Financial Services NA, LLC will not cover outstanding fees owed.

6. Vehicle Arbitration. Any issues or disputes involving a Vehicle purchased on the Site will be resolved exclusively through the arbitration process established and administered by BMW Financial Services NA, LLC (with the assistance and support of Manheim). The NAAA Arbitration Policy is used by BMW Financial Services NA, LLC as a general guideline for vehicle arbitrations, but BMW Financial Services NA, LLC reserves the right to establish its own arbitration process and policies and to make all arbitration decisions, which shall be final. No vehicle exceeding 100 miles from the time of purchase can be arbitrated.

7. Payments. Payment for each Vehicle you purchase is due on the date of sale in good funds and must include all applicable fees and other charges displayed on the Vehicle listing page or on the purchase confirmation from us, as applicable. Payments must be made to Manheim or its designated payment facilitator either directly by the registered buyer or through a pre-established direct floor planner acting on such buyer's behalf Although we reserve the right to make exceptions on a case-by-case basis, we generally will not accept other third-party payments. If payment is not received in accordance with the Late Payment Policy found in the Manheim Marketplace Policies, then Manheim may, in its sole discretion, assess a Late Fee. Our right to charge alate fee is in addition to, and not in limitation of, any other rights we or our affiliates may have. Payments must be made by ACH, by wire transfer, or by using an approved floor plan line of credit with sufficient availability to cover the full payment amount. You agree that, if any electronic debit or check/draft we (or our designated payment facilitator) present on your bank account is returned unpaid, we may debit your account for a returned item fee in the maximum amount permitted under applicable state law and any payments association rules that govern the transaction. Any returned item fee we impose is in addition to any late fee you incur and any returned item fee your Dealership's bank may impose. We reserve the right to suspend your account or buying privileges on the Site in the event of any returned or rejected payment or electronic debit request, or otherwise in our discretion. We reserve the right to change the forms and types of payments we accept in our sole discretion. Buyers making payment via a floorplan line of credit that requires manual processing may also be charged an administrative fee of up to $50 per Vehicle as compensation to Manheim for costs it incurs in processing such payments.

8. Electronic Payment Authorization. If you have elected to pay for Vehicles you purchase on the Site by automated electronic transfer from your Dealership's bank account, Manheim (or its designated payment facilitator) will attempt to debit the amounts owed for each Vehicle from the designated bank account in accordance with such authorization and these Terms of Use. Additionally, you agree that, if you designate a bank account for payment of amounts you owe us, including, but not limited to, by adding a bank account to your online profile, we may use such account information to initiate electronic debit entries to your bank account, including debit entries for amounts you owe us from time to time as such amounts become due, credit entries for amounts we owe you, and debit or credit entries in any amount necessary to correct an error. You understand that, other than account information we routinely make available to you online, we will not provide any notice to you prior to initiating entries and that you are responsible for ensuring that your account balance is sufficient to cover debits for amounts you owe us. You agree that any authorizations we initiate to your bank account must comply with applicable law and applicable payments association rules, including the NACHA Operating Rules. This authorization is in addition to, and does not terminate or alter, any other authorization for electronic payments that we have on file or that you provide us in the future.

9. Transfer of Title. Title to a Vehicle will only pass to the buyer once Manheim(or its designated payment facilitator) has received payment in full, in good funds, and otherwise in accordance with these Terms of Use. We retain a security interest in each such Vehicle in the interim to secure payment.

10. Electronic Dealing Approval. You hereby acknowledge and agree that your use of the Site requires you and us to transact business with each other electronically. You further acknowledge and agree that you are consenting to these Terms of Use both in your individual capacity and in your capacity as an authorized representative for Dealership and that your consent to this document shall be deemed to satisfy all requirements imposed on electronic or digital signatures or consents under applicable federal, provincial, and state law, including, as applicable, the Electronic Signatures in Global and National Commerce Act (the "E-Sign Act"), 15 U.S.C. § 7001(a) etseq., the Ontario Electronic Commerce Act,2000 SO c. 17, state or provincial electronic transactions or commerce laws, and any other similar laws relating to the validity or enforceability of electronic or digital signatures or consents.

11. Electronic Signatures. You acknowledge and agree that you and we may, from time to time, find it expedient to use electronic signature(s), acknowledgement(s), consent(s),"click through(s)", or other approval(s), direct or indirect, for access to auctions, bills of sale, receipts, titles, and other documents or disclosures necessary or incidental to the transaction of business on the Site, whether online, in emails, or otherwise, which makes your business with us easier, faster, or more efficient. To that end, you agree that any such forms of approval from you shall be effective and binding upon you, in the same manner as a handwritten signature, where circumstances indicate your intent to be bound and/or we choose to rely on such approval(s). You further acknowledge and agree that we may affix to any printed or electronic copy of such documents, including these Terms of Use, your electronic or digital signature in the form we choose, which shall for all purposes also be deemed your valid signature and acceptance. Regardless of whether your advance consent or approval was given, or in what form, you agree that you will be deemed to have ratified any transaction with or through us that you do not dispute in writing within 24 hours of confirmation by us.

12. Vehicle Transportation; Risk of Loss. You are responsible for the transportation of any Vehicle purchased on the Site. Vehicles must be picked up by the Dealership or its designated transport agent or other representative by no later than the fifth (5th)day following the date of sale (the "Vehicle Pick Up Deadline"). If a Vehicle is not picked up by such date, Manheim reserves the right to(a) cancel the transaction; (b)arrange for the transport and delivery of the Vehicle using a carrier of Manheim's choosing (at the Dealership's expense); (c) suspend your account or buying privileges on the Site; and/or (d) assess the Dealership a daily storage fee for the Vehicle, not to exceed $25.00 per day. Responsibility and risk of loss for a Vehicle will pass to the buyer at the earlier of (i) such time as the buyer or its transport agent or other representative takes possession or control of the Vehicle, or (ii) the Vehicle Pick Up Deadline. The buyer and its transport agent are responsible and liable for any damages and other liabilities that may arise during or in connection with the transport or delivery of a Vehicle("Transportation Claim"), regardless of whether RMSAutomotive may have provided assistance or support in arranging for the transport or delivery of the Vehicle. You acknowledge and agree that your only recourse or remedy for Transportation Claims, if any, shall be to and against the third-party carrier, its insurer, your own insurer, or the third-party that caused the alleged damage, and not to, against, or involving us. You must present your gate release documentation when picking up your Vehicle.

13. Off-Site Vehicles. For any vehicle(s)physically located away from an auction facility when auctioned on line, the buyer must present to the off-site location, or other storage facility, the proper gate release documentation issued by BMW Financial Services NA, LLC and/or RMSAutomotive (e.g., the bill of sale). It is the responsibility of the off-site location or storage facility, acting as agent for BMW Financial Services NA, LLC, to verify the authenticity of the buyer's gate release documentation before releasing the Vehicle(s) by comparing it to the gate release documentation provided directly to the off-site dealership by BMW Financial Services NA, LLC and/or Manheim.

14. Buyer/Dealership Acknowledgments. You acknowledge and agree that Manheim is merely performing a service on behalf of BMW Financial Services NA, LLC, and that Manheim makes no representation, warranty or guaranty or any kind or nature with respect to any Vehicle (including any odometer reading or any related odometer statement or certification) or any transaction that takes place on or through the Site, or regarding the availability or functionality of the Site (and all such representations, warranties and guaranties are expressly disclaimed by RMSAutomotive). You further acknowledge and agree that BMW Financial Services NA, LLC and Manheim retain the right to cease doing business with you (or any of your agents or representatives) or with any other dealer at any time and for any reason, and may discontinue the Site or your ability to purchase Vehicles or continuing using the Site at any time and for any reason. By purchasing a Vehicle on the Site, you are certifying to BMW Financial Services NA, LLC and Manheim that the Vehicle is being purchased for resale in the ordinary course of your business, and that you hold all necessary federal, state and provincial, as applicable, sales tax exemption certificates and similar documents required by the governing laws of your jurisdiction.

15. Indemnification; Limitations of Liability. You agree to indemnify and hold harmless BMW Financial Services NA, LLC, Manheim and their respective affiliates and the shareholders, members, directors, officers, employees and representatives of each of the foregoing, from and against any and all claims, judgments, damages, penalties, losses, expenses (including reasonable legal fees) and other liabilities that arise out of or relate to (a) your use of the Site; (b) any Vehicle purchase or other transaction that you may initiate or be involved with on the Site; (c)any use or subsequent sale of a Vehicle that you have purchased on the Site after you or your transport agent or other representative has taken possession of the Vehicle; or (d) your breach or violation of any of these Terms of Use. UNDER NO CIRCUMSTANCES WILL BMW Financial Services NA, LLC OR MANHEIM BE LIABLE TO YOU OR ANY OTHERPERSON FOR ANY DAMAGES OR OTHER LOSSES ARISTNG OUT OF YOUR USE OFOR RELIANCEON THE SITE OR ANY CONTENT AVAILABLE ON OR THROUGH THE SITE.

16. Updates and Modifications. We may update or modify these Terms of Use from time to time by posting an updated or modified version of the Terms of Use to the Site. lt is your responsibility to regularly check and monitor the Site for any updates or modifications to the Terms of Use. By continuing to use or access the Site following the posting of any updates or modifications to the Terms of Use, you agree to be bound by such updates or modifications.
